Specter: Doesn't your email of November 15 to Ms. Miers and specifying her role in the evaluation of selection of interim candidates raise a pretty clear inference that it was more than just a staff recommendation; that there had been at a minimum acquiescence in this process to use the Patriot Act to circumvent the Senate?

Sampson: That email is in reference to the eastern district of Arkansas. I did have that idea and I did recommend it [to use the Patriot Act provision to circumvent Senate conformation] but it was not adopted by the AG and it was not adopted or rejected by Ms. Miers, according to my recollection.
